Terms of Service
These terms govern access to the Kigenix website, merchant application, pilot program, and related services.

1. Acceptance
By accessing or using Kigenix, you agree to these Terms and our Privacy Policy. If you use Kigenix for a business, you represent that you have authority to accept these Terms for that business.
2. Eligibility and accounts
You must be at least 18 years old and capable of entering a binding agreement. You are responsible for accurate account information, safeguarding access to your account, and promptly reporting suspected unauthorized use.
3. The Service
Kigenix provides tools intended to help businesses understand public discovery signals, connected reviews, business information, and possible next actions. Pilot, preview, or demonstration features may use illustrative data and may change before general release.
Kigenix does not guarantee search placement, AI recommendations, ratings, revenue, customer demand, or any particular business outcome. Recommendations and drafts are informational and should be reviewed by an authorized person before use.
4. Google connections
Google sign-in and Google Business Profile authorization are separate. You may use basic account sign-in without connecting a Business Profile. If you connect a Business Profile, you authorize Kigenix to access only the Google accounts and locations you select and are permitted to manage.
You remain responsible for your Google account, Business Profile, content, and compliance with Google's terms and policies. Unless an action is clearly presented and specifically approved by an authorized user, Kigenix will not publish review replies or change Business Profile information.
You may revoke access or request disconnection as described on our Data Controls & Deletion page.
5. Your responsibilities
You agree that you will:
- Connect only accounts and locations you own or are authorized to manage.
- Keep merchant membership and access permissions accurate.
- Review proposed content and changes before authorizing publication.
- Comply with applicable laws, platform policies, and third-party rights.
- Not use the Service for spam, deceptive activity, surveillance, harassment, or unlawful discrimination.
6. Prohibited use
You may not interfere with the Service, bypass access controls, probe another merchant's workspace, submit malware, scrape the Service at unreasonable volume, reverse engineer protected components except where law permits, or use Kigenix to access or alter a Business Profile without the owner's authorization.
7. Your content and feedback
You retain ownership of content you provide. You grant Kigenix a limited permission to host, process, and display that content only as needed to operate and improve the Service. You represent that you have the rights needed to provide it.
If you voluntarily provide product feedback, Kigenix may use it without restriction or payment, provided we do not publicly identify you without permission.
8. Kigenix intellectual property
Kigenix and its software, design, branding, documentation, and original content are protected by intellectual-property laws. Except for the limited right to use the Service under these Terms, no rights are transferred to you.
9. Third-party services
The Service may depend on Google, Supabase, Vercel, and other providers. Their services are governed by their own terms and may change or become unavailable. Kigenix is not endorsed by or affiliated with Google merely because it uses Google APIs.
10. Availability, changes, and suspension
We may modify, limit, or discontinue features and may suspend access when reasonably necessary to address security, legal, abuse, nonpayment, or policy risks. Where practical, we will provide notice and a reasonable opportunity to export or delete data.
11. Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available.” Kigenix disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.
12. Limitation of liability
To the maximum extent permitted by law, Kigenix will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost revenue, lost data, or loss of goodwill arising from the Service. Nothing in these Terms excludes liability that cannot lawfully be excluded.
13. Termination
You may stop using Kigenix at any time and may request deletion through our data-controls process. Provisions that by their nature should survive termination—including ownership, disclaimers, limitations, and dispute terms—will survive.
14. Governing law
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Any dispute will be brought in a court of competent jurisdiction located in New York, unless applicable law requires otherwise.
15. Changes and contact
We may update these Terms and will post the revised effective date. Material changes will be communicated when reasonably required. Questions may be sent to receive@kigenix.com.
